Terms of Service

1. Acceptance of Terms

By creating an account or using the Imotionary platform, you agree to these Terms of Service. If you do not agree, do not use the platform. These terms constitute a binding agreement between you (or the organisation you represent) and Imotionary Ltd.

2. The Service

Imotionary provides an AI-powered video production and distribution platform. We grant you a limited, non-exclusive, non-transferable licence to use the platform in accordance with these terms and your active subscription plan.

3. Your Account

  • ●You are responsible for maintaining the security of your account credentials.
  • ●You must provide accurate information when creating your account.
  • ●One account per individual user. Sharing account credentials is not permitted.
  • ●You must be at least 16 years old to create an account.

4. Credits and Billing

  • ●Credits are consumed at the point of video rendering. One credit = one rendered video.
  • ●Credits are non-transferable and non-refundable except where a render fails due to a platform error.
  • ●Failed renders caused by platform errors automatically trigger a credit refund. Failed renders caused by invalid user configuration are not refunded.
  • ●Subscriptions renew automatically at the end of each billing cycle. You can cancel at any time.
  • ●Annual subscriptions are refundable within 30 days of purchase on a prorated basis.
  • ●We reserve the right to change subscription pricing with 30 days notice to existing subscribers.

5. Content You Create

  • ●You retain ownership of all content you create using Imotionary.
  • ●By using the platform, you grant Imotionary a limited licence to store, process, and transmit your content solely for the purpose of providing the service.
  • ●You are responsible for ensuring your content does not infringe third-party intellectual property rights.
  • ●You may not use Imotionary to create content that is illegal, defamatory, harassing, obscene, or in violation of any applicable law.

6. Prohibited Use

You may not use Imotionary to:

  • ●Create deepfakes or impersonate real individuals without explicit consent
  • ●Generate content designed to deceive or defraud
  • ●Create content that promotes violence, hate speech, or discrimination
  • ●Violate any applicable law or regulation
  • ●Reverse engineer, copy, or resell the platform
  • ●Use automated scripts to access the platform outside of the official API

7. AI Content and Accuracy

Content generated by AI on Imotionary is not guaranteed to be accurate, appropriate, or fit for any specific purpose. You are responsible for reviewing AI-generated content before publishing it. Imotionary is not liable for errors, inaccuracies, or harm arising from published AI-generated content.

8. Platform Availability

We aim for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance windows are announced at least 24 hours in advance. Unplanned outages are communicated via status.imotionary.com.

9. Termination

We may suspend or terminate accounts that:

  • ●Violate these terms
  • ●Use the platform for fraudulent or illegal purposes
  • ●Reverse engineer or attempt to access restricted systems

You may delete your account at any time. See our Privacy Policy for data retention following account deletion.

10. Limitation of Liability

To the maximum extent permitted by law, Imotionary liability for any claim arising from use of the platform is limited to the amount you paid in the 3 months preceding the claim.

11. Governing Law

These terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
