By accessing or using VideoAI Automation Platform (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. We may modify these Terms at any time. Continued use after changes constitutes acceptance.
VideoAI is a SaaS platform that automates video creation using AI models (Claude via OpenRouter, FLUX via fal.ai, ElevenLabs TTS, Remotion rendering) and distributes content to social media platforms via Upload-Post. The Service includes script generation, scene breakdown, asset generation, narration, video rendering, captioning, and multi-platform publishing.
You must be at least 16 years old. If you are between 16 and 18, you must have parental or guardian consent. You must not be located in a country subject to applicable sanctions or export controls.
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use. We may suspend accounts for security violations or suspicious activity.
The Service operates on a credit-based subscription system. Credits are consumed per video generated based on the selected engine. Credits are non-refundable except where required by law. Subscription fees are billed in advance monthly or annually. You may cancel anytime; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with 30 days notice.
You may not use the Service to create, generate, or distribute: illegal content; hate speech; sexually explicit content depicting minors; content infringing intellectual property rights; malware or spam; misinformation intended to cause harm. You may not reverse-engineer, scrape, or abuse API rate limits. You may not use the Service to generate content impersonating real individuals without consent (deepfakes for impersonation).
All AI-generated scripts, images, narration audio, and videos are generated using third-party AI services. YOU ARE SOLELY RESPONSIBLE FOR REVIEWING, EDITING, AND APPROVING all AI-generated content before publishing. We provide the platform only; we do not endorse, verify, or guarantee the accuracy, legality, or appropriateness of AI outputs. You must not publish AI-generated content without human review. You retain ownership of all original content you provide (topics, scripts, brand assets). We grant you a limited, non-exclusive license to use the platform solely for generating videos per your subscription. We retain ownership of the platform software, UI, and generated platform infrastructure. AI-generated assets are licensed to you for your own social media publishing purposes; you may not resell rendered videos as stock footage.
Your use of social media publishing features is subject to the terms of service of the respective platforms (TikTok, Instagram, YouTube, Facebook, X, LinkedIn, Pinterest, etc.). We are not responsible for platform policy changes, API deprecations, or account suspensions by third parties. Upload-Post is a separate service; we are not liable for their uptime or data handling.
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated content will be accurate or suitable for your purposes. All AI outputs should be treated as drafts requiring human review.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIDEOAI AND ELVIS EKOIGIAWE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
We may terminate or suspend your account at any time for violations of these Terms, fraudulent activity, or non-payment. You may terminate your account at any time via your Settings page. Upon termination, all credits are forfeited. We retain anonymized usage analytics and payment records per legal requirements.
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict of law principles. Any disputes shall first be attempted via good-faith negotiation, then binding arbitration in Lagos, Nigeria, under the Lagos Court of Arbitration rules.
